Terms of Sale

Last updated: 2026-09-26

1. Purpose and parties

These terms of sale ("Terms of Sale") apply to subscriptions to the paid plans of the Kuratos service, published by Yann ADORNI, sole trader, SIRET 978 733 723 00040, 39 chemin de Pibrac, Villa 05, 31880 La Salvetat-Saint-Gilles, France. They are accepted by the customer at the time of order and supplement the Terms of Use.

2. Plans and prices

Paid plans are described on the Premium page and in the dashboard. Each plan covers a number of included servers — 3 for Intermediate and Modular, 10 for Complete — extendable with extra servers billed on the same cycle as the subscription (€3.33 per server per month for Intermediate and Modular, €2 for Complete; the Modular rate follows its composed price divided by three). Extra servers are a subscription, not a one-off purchase: they follow the same cancellation, withdrawal and pro-rata refund rules as the main subscription, with no separate conditions. Each purchase of an extra server is nonetheless a separate contract: its fourteen-day withdrawal period runs from that particular purchase, independently of the date the main subscription was taken out. Prices are shown in euros, VAT not applicable (article 293 B of the French General Tax Code): no VAT is charged or recoverable. The publisher may change its prices; the applicable price is the one displayed at the time of subscription, and any increase affecting an ongoing subscription is announced before it takes effect, the customer being free to cancel at no cost before the due date. Any change to prices or conditions affecting an ongoing subscription is announced by email and on the What's new page at least thirty days before it takes effect. The customer may cancel at no cost before that date; otherwise, the new conditions apply from the following period.

3. Capacity

Paid plans may only be taken out by adults, or by minors with the authorisation of their legal representative — who must then provide the payment method. The publisher may terminate a subscription taken out in breach of this rule and refund the amounts charged.

4. Subscribing and payment

Subscriptions are taken out from the dashboard. Payment is processed by Stripe Payments Europe Ltd. (stripe.com), an authorised provider: card details are entered on a page hosted by Stripe, never pass through our servers and are never stored there. Accepted payment methods are those offered by Stripe for the euro area and displayed at checkout. The order is final once payment is confirmed; a receipt and all subsequent invoices are available at any time from the Billing tab.

5. Subscription, term and renewal

Subscriptions are entered into for the chosen term — monthly, quarterly or yearly — and renew automatically for an identical term unless cancelled before the renewal date from the Billing tab. Payment is taken on the first day of each new term. Changing plan (upgrade or downgrade) takes effect according to the terms shown at the time of the change, with pro-rata adjustment handled by the payment provider. Moving down to a lower plan, like cancelling, returns the settings specific to paid features to their default values (section 10); they are not restored if a new subscription is taken out.

6. Free trial

Where a free trial is offered, its duration is stated before subscribing. No amount is charged during the trial; at its end, the subscription continues at the displayed price unless cancelled beforehand, which is possible at any time from the Billing tab. The trial is limited to one per account and per server: it is refused if the account has already used one — including after deleting and recreating the account, a pseudonymised identifier being kept for that single purpose — or if any of the servers the customer administers has already used one, whoever started it. It is also refused when that list of servers cannot be checked with Discord at the time of the request. Subscribing without a trial remains possible in every case.

7. Right of withdrawal

A consumer customer has fourteen days from the conclusion of the contract — that is, from subscribing, free trial included — to withdraw without having to give any reason. Immediate access. By ticking the box provided before payment, the customer expressly requests that the Service begin before the end of that period. If they then withdraw, they remain liable for an amount proportionate to the service supplied up to the point their decision is communicated (article L221-25 of the French Consumer Code); the remainder is refunded. How to exercise it. The customer informs the publisher of their decision before the period expires, by an unambiguous statement sent to [email protected], or using the model form in the annex, whose use is not mandatory. Refund. Amounts due are refunded within fourteen days of receiving the decision, to the payment method used when subscribing. The right of withdrawal affects neither cancellation, possible at any time, nor the statutory guarantee of conformity (section 8), nor the guarantee against hidden defects, nor the refund of an amount wrongly charged. Where the law of the consumer's habitual residence grants a longer period or broader protection, that rule applies instead.

8. Statutory guarantee of conformity

Kuratos is digital content supplied continuously for the whole term of the subscription. The publisher must therefore keep it CONFORMING to its description for that entire term, not merely on the day of purchase, and must provide the updates needed to maintain that conformity. This guarantee is governed by articles L224-25-12 and following of the French Consumer Code, which are specific to digital content — not by the regime applicable to physical goods. Where the Service does not conform, the customer may first require it to be BROUGHT INTO CONFORMITY, free of charge. If that is impossible, does not happen within a reasonable time, or causes them major inconvenience, they may obtain a PRICE REDUCTION or TERMINATION of the contract, with a refund for the non-conforming period. This guarantee is free and applies as of right. No clause of these terms — including any mention that the Service is evolving or experimental — can exclude or limit it: such a clause would be deemed unwritten. A defect appearing during the supply period is presumed to exist for the purposes of this guarantee. It is independent of any goodwill gesture the publisher may otherwise make.

9. Refunds

Refund requests may be sent to [email protected], stating the email address used to subscribe and the reason. Every request receives a reply within fourteen days. A refund is granted as of right where an amount was wrongly charged, where the service was not provided, or under the statutory guarantees; it may be granted as a goodwill gesture in other cases. Refunds are processed by the payment provider and returned to the original payment method, within the usual banking time of five to ten working days. Before raising a dispute with their bank, the customer is asked to contact the publisher: a chargeback results in immediate suspension of paid access while it is investigated.

10. Cancellation

The customer may cancel at any time, without reason or cost, from the Billing tab. Paid access remains active until the end of the period already paid for, after which the server automatically returns to the free plan. Settings specific to paid features revert to their default values; server data itself is retained. The publisher may terminate in the event of non-payment after a reminder, or of a serious breach of the Terms of Use.

11. Voluntary contributions

Contributions made from the Support page are not a subscription and unlock no advantage on the Service: no discount, no feature and no priority support. A contribution can be refunded on simple request sent to [email protected] within fourteen days of the payment.

12. Customer service

For any question about an order or a subscription: by email at [email protected], or on the Ombrix Discord server.

13. Governing law and disputes

These Terms of Sale are governed by French law. Where the customer is a consumer residing in another country, this choice does not deprive them of the mandatory protections of the law of their habitual residence: between two rules, the one more favourable to the consumer applies. In the event of a dispute, an amicable solution is sought first; failing that, the consumer may use a consumer mediator free of charge, or bring the matter before the court of their place of residence.

Annex — Model withdrawal form
